Two men break in to an Oklahoma home with just an 18-year-old woman - whose husband died of cancer on Christmas day - and her baby inside. She shoots one, killing him, while she has a 9-1-1 dispatcher on the phone. Now, his accomplice, 29-year-old Dustin Louis Stewart, is charged with murder. As for the homeowner...
FOX News Radio's Sal Giangrasso reports she stands on solid legal ground:
Police won't be filing charges against an Oklahoma woman who shot and killed an intruder at her house New Year's Eve, while she had a 9-1-1 dispatcher on the phone.
(911 Tape) "I've got two guns in my hand. Is it okay to shoot him if he comes in this door?//I can't tell you you can do that, but you do what you have to do to protect your baby."
And 18-year-old Sarah McKinley says...
(McKinley) "I waited 'til he come in the door, and when he did, I shot him. I didn't know what else to do."
Oklahoma law allows the use of deadly force against intruders, and prosecutors say McKinley clearly acted in self-defense. The 24-year-old, Justin Martin, was holding a knife when he died.
