SCOTUS Sends Obama-Care Religious Exemption Contraception Case Back to Lower Courts
In the fight over Obama-Care’s birth control provisions, the Supreme Court has sent several challenges back to the lower courts for reconsideration. And it carefully decided NOT to rule on the merits of the “Little Sisters of the Poor” and other challenges.
FOX’s Jared Halpern has more from Washington:
The Supreme Court justices are asking lower courts to consider middle ground in a legal fight, putting affordable birth control against religious freedom.
In the meantime, faith-based non-profits like the ‘Little Sisters of the Poor’ will not face fines for failing to sign off on contraception coverage for employees:
(Rienzi) “The government simply does not need religious institutions and their health plans to give out contraception.”
Attorney Mark Rienzi with the Becket Legal Fund for Religious Liberty calls this opinion a win, though the Justices say they are not ruling on whether the birth control mandate violates religious freedom.
