Former Assistant U.S. Attorney for the Southern District of New York Andy McCarthy joins Fox Across America With guest host Paul Gleiser to give his take on the Department of Justice indicting former President Trump  on 37 criminal counts for mishandling classified documents, and whether he thinks this decision was politically motivated.

“They tried to knock him out in 2016. And once he won the presidency, they tried to hamstring his presidency so he couldn’t govern. So I get all that. But I think the fact that that narrative is a viable one should not obscure from us the fact that this particular case that they brought is not manufactured like the Russiagate allegations. There was no evidence to them. Here, there’s not only evidence, but most of the evidence comes either from documents that President Trump doesn’t deny that he had in his possession. In fact, you know, he’s trying to come up with rationales why it should have been okay for him to have them in his possession. But he can’t credibly claim that he didn’t have them. And the main witnesses are people who, you know, they’re hardly Trump haters or Never Trumpers or people who had it in for Trump. These are people who were actually trying to help him. These were his lawyers who he dragged into the middle of all this. And they tried very hard when the prosecutors tried to subpoena them and get Trump’s attorney client privilege eviscerated on grounds of a legal doctrine known as the crime fraud exception, they fought that very hard. They fought it in the district court. They fought it in the court of appeals, and they lost. And it was only then that reluctantly, because like all of us that have an obligation if they get subpoenaed to the grand jury, they have to tell the truth, they told the truth. But they really tried not to have to do it.”
