New Mexico: Poison Spill is Colorado’s Fault

    FOX’s Anna Welles reports:

    The massive waste water spill from the Colorado mine turned the Animas River yellow with a toxic mix of arsenic, lead and other heavy metals last August. The plume went down river into New Mexico and Utah.

    New Mexico claims Colorado is directly responsible for the contamination as well as decades of acidic drainage from mines near the headwaters of the Animas River.

    In the lawsuit filed in the U.S. Supreme Court, New Mexico claimed it’s paying the price for two decades of disastrous environmental decision making by Colorado.

    New Mexico is also suing the U.S. Environmental Protection Agency and the mine owners.

    Colorado has previously declined to comment on New Mexico’s claims citing possible litigation.
