A school gets the green light to punish a kid for comments about greens.

FOX's Lilian Woo reports: 

New Jersey education officials say a school is allowed to give detention to a sixth grader for telling a student who did not eat meat that vegetarians are "idiots and that he should eat meat because he'd be smarter and have bigger brains."

School officials found the comments were harassment, intimidation and bullying because they targeted a distinguishing characteristic under state law and that child received five detentions, but the parent of the 11-year-old challenged whether being a vegetarian met the legal definition of a distinguishing characteristic.

The judge believes it does. The parents attorney says he does not plan to appeal.
