An escaped killer is back in custody in New York.

David Sweat is in critical condition after he was shot twice in the torso yesterday , refusing to stop after a police sergeant told him to.

(Pamela) "I'm glad he's not dead."

...That's his mother, Pamela.

Meanwhile, two prison workers face charges in connection with the escape. Governor Andrew Cuomo says they'll be dealt with...

(Gov. Cuomo) "We want to send a very clear message - any prison worker who cooperates with an escapee... That is a crime in and of itself."

Sweat and Richard Matt had been on the run since June 6th. Matt was shot and killed by a Customs and Border Patrol Agent on Friday.
