Court: Lap Dances Aren’t Art, Are Taxable

    The New York Supreme Court has issued a ruling on what kind of dancing constitutes art, and can therefore avoid being taxed.  Lap dancing?  Not one of them.

    FOX News Radio’s Jane Metzler reports the case could eventually appear before the U.S. Supreme Court:

    New York’s highest court ruling 4-3 that this kind of dance doesn’t promote culture.  On the other hand, ballet and other artistic endeavors contribute to the community.  The court turning down an Albany-area strip club’s request for a sales tax exemption on admission and lap dances.

    New York doesn’t tax admission for live dramatic, choreographed or musical performances.  Dissenting Judge Robert Smith noting the women at Nite Moves do dance.  The judges in the majority saying gyrating on a pole is not what lawmakers had in mind.
