What If It’s A Tie?
Forget about a recount. What happens if Election night ends in an Electoral College tie?
FOX News Radio’s Jared Halpern breaks it down from Washington:
It takes 270 Electoral College votes to capture the White House. But what happens if the final tally is 269-269? In that unlikely, but possible scenario, Article 2 of the Constitution makes the U.S. House a tie-breaker.
Here’s how it would work:
The newly elected House, taking office in January, would take the vote. Each state delegation gets one vote. As it stands, Republicans would likely control a majority and presumably, elect Mitt Romney President.
However, the Senate votes separately for Vice President.
