Floyd Abrams, staunch defender of the FIRST AMENDMENT and author of ‘Friend of the Court: On the Front Lines with the First Amendment’, joined Brian IN STUDIO and offered up his expert analysis on the DOJ investigating Fox’s own James Rosen. Abrams explained Rosen’s situation, “Really breaks the sound barrier. It is one thing to subpoena journalists—journalists can go to court, they can fight back, they can get a judge to decide—but to say that a journalist has committed a criminal act for committing an act of journalism for really asking questions of a source. To say that in a document filed in a court is really outrageous and a matter of real concern because this breaks all the old rules of how the dance sometimes between the government and the press is played.” Abrams continued, “If asking someone in the government questions, even about classified material, and asking the questions is itself a crime, then WE ARE IN A VERY DANGEROUS STATE THAT WE HAVE NEVER BEEN IN BEFORE IN THIS AREA!”
