Former Assistant U.S. Attorney for the Southern District of New York Andy McCarthy joins Fox Across America With guest host Jason Chaffetz to share his reaction to the Department of Justice indicting former President Trump over his handling of classified documents.
“They didn’t have to do this. But by virtue of them having done it, it seems to be the two things that they’ve made a certainty now is that every day Trump is going to be talking about the Espionage Act and the fact that Biden is guilty under it. And that happens to be true. You know, they’re trying to obscure that because they’ve indicted Trump on a provision that requires willful behavior. But, you know, first of all, I’m not exactly sure that Biden hasn’t engaged in willful behavior, because if he took documents out when he was a Senator, you’re not allowed to take documents out as a Senator. So that can’t be a mistake. He had to have done it willfully. But also, he’s guilty under the provision of the Espionage Act that talks about gross negligence and that, you know, the Justice Department can try to pretend that that’s not serious. Congress made that a ten year felony. So Trump is going to be making this an issue every single day. And I think with the weight of that in combination with the Biden family influence peddling scheme, Biden is going to be in a world of hurt using the criminal justice system the way that they have used it, because now his activity, I think, is going to be a part of this campaign in a way that it might not otherwise have been.”
