On Fox Across America with Jimmy Failla, “Fox News @Night” anchor Shannon Bream gives her perspective on the chance Justice Stephen Breyer steps down from the Supreme Court to let President Biden choose his replacement.
“These men and women on the Court are so cognizant of being portrayed as political that they do everything to push back against that. So I think in Stephen Breyer’s mind, he is a serious jurist and he does not like being pushed around by politicians, Democrats or Republicans. And the left is really pushing him right now, like don’t die in there like Justice Ginsburg, and they’re furious at her and you got to step down. And I think in his mind, he’s like that is the kind of thing that makes the court look political. He keeps yelling at Democrats, stop talking about packing the court, because what about if Republicans are in charge, they’re going to do the same thing. They want to be seen as neutral arbiters who are jurists, whatever their judicial philosophy is. They don’t like to think in terms of Democrats or Republicans. But he acknowledges, like, I’m not a dummy. I know what’s going on in the world. He acknowledges that part of the conversation. But I think the more the left pushes him, the more they push him away from retiring next year.”
