Senator Mike Lee, The United States Senator From Utah joined Fox News Radio’s Guy Benson Show to discuss the recent ruling from the Supreme Court that backs a Catholic adoption agency in a case on foster care.

Senator Lee weighed in saying,

“Guy you’re absolutely correct to focus on the fact that its significant nine justices, all nine of them, concluded that this was a violation of the free exercise clause of the U.S. Constitution. There are some things the government cannot do. And one of the things that government cannot do under the First Amendment is to identify certain religious beliefs, teachings and practices and singled them out to be disfavored. And whereas as here, it acts in such a way that if the general isn’t generally applicable or religiously neutral, it’s going to have to satisfy the strictest of scrutiny and it fails to be able to do that. Here with the city of Philadelphia, Philadelphia stopped using the Catholic Social Services certification by the city of Philadelphia on the sole basis that the city of Philadelphia, for religious reasons, doesn’t recognize same sex marriage. And on that basis, it excluded the Catholic Catholic Social Services from the foster care program that’s long been run by the city of Philadelphia. They’ve been holding this for 50 years. And the Catholic Social Services has been an active participant only recently to the city of Philadelphia acting against them. And the Supreme Court today said that’s not acceptable. You’re discriminating against their religious belief.”
