Judge Andrew Napolitano: DC Threatening Jail During The Coronavirus Crisis Is”Good” Intimidation, But It’s Not Enforceable

On FOX Across America With Jimmy Failla, Fox News Senior Judicial Analyst Judge Andrew Napolitano discussed how Washington DC Mayor Muriel Bowser will not be able to enforce jail time on those who leave their home during the coronavirius outbreak.

“The city jail in Washington, D.C. is emptying itself of elderly non-violent criminals, because the jail is infected with coronavirus. At the same time, the mayor is threatening to lock people up in that same jail if she sees them walking in the streets. Corrupt people of Washington DC that work for the federal government, she can’t lock them up because the supremacy clause makes the feds trump lower any local rule. So what is she trying to do? She’s just trying to intimidate. Intimidation is good. It scares people into doing the right thing, but it cannot be backed up with police and with the force of prosecution.”
