LAWYER: When An Officer Says “You’re Under Arrest”, It’s Not a Suggestion
ARTHUR AIDALA a New York criminal defense lawyer and legal analyst on Fox News Channel called in to talk about the Eric Garner grand jury decision. Arthur explained that he doesn’t feel that this was a racist act by the officer, and that under the same circumstances the result would have been the same if he was a white man. Arthur also said that once an officer says you are under arrest it is not a suggestion. It is a tragedy what happened and that maybe we do have to look at the grand jury system and make some changes.
Arthur also explained that it is not unheard of for a police officer to testify in front of a grand jury, although it is very odd for a civilian to tesify as a defendant.
