A 12 year-old in Florida is charged with first degree murder for killing his 2 year old half brother.

He's accused of beating the toddler to death.

Fernandez is the youngest person ever in the city of Jacksonville to be charged with such a crime.

He's been indicted and charged as an adult.

Charged as an adult???

That's a little young - isn't it?

"And in the Florida law, regardless of age, if you are indicted for a crime punishable by death or life in prison, you have to be tried as an adult."

That's Legal Expert Brett Myers speaking with Rob at WGST in Atlanta.

If convicted, will he still serve his time in a juvenile facility?

"Yeah, that's what they're working on. That's the real rub right now. Because from what I can tell they are close to reaching some type of plea bargain. The sticking point is that exact point, is how much time can this 12 year-old serve in a juvenile facility before he gets transferred over to an adult."
