He's accused of beating the toddler to death.
Fernandez is the youngest person ever in the city of Jacksonville to be charged with such a crime.
He's been indicted and charged as an adult.
Charged as an adult???

"And in the Florida law, regardless of age, if you are indicted for a crime punishable by death or life in prison, you have to be tried as an adult."

If convicted, will he still serve his time in a juvenile facility?
"Yeah, that's what they're working on. That's the real rub right now. Because from what I can tell they are close to reaching some type of plea bargain. The sticking point is that exact point, is how much time can this 12 year-old serve in a juvenile facility before he gets transferred over to an adult."
