A six year old - slapped with an in-school suspension - during his first week of elementary school in San Antonio.

Why?

Get this one.

It's because of the length of his hair!

"If people see a picture of him - it's not as if his hair is even hanging down to his shoulders - it's like a little curly bushy haircut for a 6 year old kid - and the school is making the subjective determination that it's not neat and clean enough - so he's going to be on suspension."

Attorney Justin Leto speaking with Chip at KOGO in San Diego.

Well the school says that the boy's hair - violates the school's dress code.

But - little Gareth - is growing his hair - for locks of love.

"The hair is being grown to donate it for people who don't have any hair because they don't have any hair. "

As Leto mentions - the hair will be donated to patients who don't have hair - because they are suffering with cancer.

Justin, what's the big deal?

"I think that the problem with these education systems - with these public schools - is they're focusing so much on this garbage - which I think this totally is garbage - and they're not focusing on what they should be - which is educating their students."

The school also saying that it's not just about Gareth's hair - but also about his little diamond earring.

His Mom, Kandi Shand vows to fight the School District to allow her son to wear his diamond earring.

We'll have to see if this pops up in the courts.

I have a feeling it will.
