Sen. Jeff Sessions, R-Ala., is demanding answers after a report surfaced that a U.S. Immigration and Customs Enforcement agent is facing punishment for arresting an illegal immigrant.
The unidentified agent could face a three-day suspension after he arrested a 35-year-old illegal immigrant from Mexico who had as many as 10 traffic violations. He was nabbed in Newark, Del.
The agent was ordered by supervisors to release the individual because he was not a “priority target.” When the officer balked, he was threatened with a three-day suspension and the illegal alien was let go.
“The actions that it appears were taken by your agency send a message to agents in the field that they will be punished for doing their duty and enforcing the law,” Sessions wrote in an letter to ICE Director John Morton and obtained exclusively by Fox News.

A spokesperson for the Newark Police Dept. told Fox News that had an American citizen been stopped under the same circumstances – they would have been jailed. Sessions said that is a troubling revelation.
“Federal law enforcement should certainly not be giving illegal aliens more preferential treatment that is afforded American citizens,” Sessions wrote. “Your agency’s apparent treatment of the criminal alien sends the troubling message that the demands of public safety are trumped by the desire for reduced deportations of those deemed ‘not presidential priorities.’”

Sessions is demanding that ICE provide a detailed account of the events involving the agent along with an explanation of why the illegal alien was released and allowed to pose a threat to public safety.
Word of the agent’s pending punishment for simply doing his job has outraged ICE agents.
“They’re punishing law enforcement officers who are just trying to uphold U.S. law,” said Chris Crane, president of the National ICE Council. Crane is a union representative acting on the unidentified officer’s behalf.
The officer under fire is an 18-year law enforcement and military veteran.
“They’re willing to take away their retirement, their job, their ability to support their families in favor of someone who is here illegally and violating our laws,” Crane told Fox News. “Right now (the Obama administration) is standing in the way of us enforcing the law by either taking a disciplinary action, threats of disciplinary action, or refusing to sign off on charging documents to put an illegal alien into immigration proceedings so a judge can sort it out.”
“If a law enforcement officer can’t perform routine enforcement functions, what do we have a law enforcement agency for,” Crane wondered.

Unless the arrest was made illegally–I'm not sure how anyone can tell a federal law enforcement officer to release someone (with the exception of a court). If this is allowed to happen–then it would mean his superior could break the law–and not be arrested just because his staff is ordered not to do it. Doesn't work that way. A police officer (or ICE agent) is given his power by the state (or city/county). It's done this way so that no one is above the law. A police officer in your city can arrest the Chief of Police (his boss) or the mayor for a crime. Bad things happen when people can be "unarrested" just because some supervisor says to do it.

Sounds like his supervisors are trying to use insubordination as the excuse for punishing him. The problem is, if the order he is given violates the law, then refusing to follow that order is not insubordination.

Really? You're not sure how a department can set policy as to which cases they prosecute and which cases they don't? You've clearly never worked in a law enforcement office. Technically, you can be arrested for jaywalking in most jurisdictions, but if a police officer does it, they will get in trouble because it violates department policy. They have more important things to worry about, and a police officer focusing on their own priorities rather than the priorities of the department will get in trouble. That's what the chain of command is all about.

David Cook The department my husband works for fired an officer for repeatedly arresting individuals driving between 1-14 miles above the speed limit, after being told by his commander not to do so in writing 8 times. Even the union's arbitrator agreed the department had the right to fire that officer for insubordination, and their arbitrator never agrees with the department's discipline policies. You really think a department can't determine who to arrest and who to let go?

Well Sally Paxton, we might have more money in the ICE budget if as a country we weren't giving so much money to illegal immigrants in services, not to mention sending lots of benefits to Mexico for people that don't even live here but are taking advantage of America's silly concept that we need to support people instead of making them responsible for themselves. Edna Gonzalez No, do you have trouble with reading comprehension? I don't think the officer should be punished for arresting the illegal immigrant, I DO believe the officer should be punished for insubordination without good cause. My husband's department doesn't arrest motorists because it's a waste of resources in our mind, but we sure as heck will spend those resources to discipline an officer who disobeys a command. An officer that disobeys a command without a strong compelling reason (and a mere policy difference is certainly not a strong compelling reason) is a danger to the entire department.
Sally, if an ICE officer cannot arrest an illegal immigrant, then that whole department is not needed and the department should be let go or moved into another dept of government.
When this illegal alien now kills someone, everyone will be crying bloody murder as to why this guy was let go. At least the suspended officer covered his a$s in case that does happen.

Second, they can and do arrest illegal immigrants, millions of them every year in fact, it's just against their policy to do so with those whose crimes, besides illegally immigrating, are below misdemeanor level (traffic violations, in this case) because there are too many of those types of people, and the department can't handle all of that. Your argument amounts to "If xyz law enforcement department doesn't arrest criminals, they might as well not exist" when in fact, the law enforcement department does arrest criminals, just not one whose only crime is speeding. You really think a person whose only criminal history, besides crossing our borders illegally, consists of traffic violations is likely to murder someone? That's an unbelievably huge jump.
Sally, the immigrant had 10 previous traffic violations. So you are saying no one has ever been killed in a car accident before? Then guess what? The media will see the illegals record, and wonder why nothing was done to prevent it.
If your husband really is a LEO, he should know first hand then that most illegal immigrants laugh or have smile on there face when they get arrested for a traffic offense, as they know nothing will be done to them, even if they provide fake information to an officer.

Sally..it is NOT insubordination to refuse to follow an unlawful order. Many crimes throughout history have been committed using the excuse "I was just following orders." I suspect if this agent refused to follow an order to unlawfully treat or detain this individual your view would be different.

I'm saying that ICE believes it has more important things to do, and that's their prerogative. My husband is the general counsel for our local police department (in other words, the lawyer), and he has to fight idiot officers who think they have the right to make department policy and override our elected sheriff. Rank and file LEO's don't make policy, and when they go out on their own and try to arrest low level offenders and put them in jail for smoking less than an ounce of pot or jaywalking or going 3 miles over the speed limit, the department has to pay for that, which means less money the department has for important investigations like murder or DWI or major fraud or actual drug trafficking. What is so hard to understand about that being dangerous?

You think it's unlawful for a department to say "No, we're not going to arrest speeders, because we have better things to do"? And besides that, DWI is not a traffic violation in any state, it would be at least a misdemeanor and occasionally a felony, so he has not been convicted of that as far as the story says.

Actually, if you want to get technical, you don't say anything about traffic accidents until the next post. It's beyond me that this is your justification for why this officer should be allowed to disobey his commanding officer, because the illegal immigrant has "up to 10" traffic violations. You really think this illegal immigrant is so much more likely to kill someone because of that that insubordination is insignificant compared to deporting this guy? Do you believe that's a rational position?
Sally….first off questioning people's sanity is not productive to the conversation. Is it your contention that everyone who does not share your opinion is out of their mind? Secondly the federal world works differently than things at the local and state level so your comparisons to the department your husband works with are likely inaccurate. Third since your husband is a lawyer who's job it is to keep his bosses out of legal hot water I suspect neither he, nor you, understand the concept of what does and does not constitute a lawful order to people who actually put their lives in danger for a living. Fourth, perhaps you should ask your husband how his department would deal with a lawsuit resulting from the death or serious injury by this person who was allowed back on the street regardless if the damage was done in an "accident" or purposeful. Even money says they would scapegoat the officer who failed to make the arrest. Or maybe you should ask yourself how you would feel if this person got in a 4000lb weapon and killed your husband or your children and then you found out that it didn't have to happen. We aren't talking about a couple low level traffic citations. We are talking about an established pattern of disregard for the law and the safety of others. Edward Loder I'm sorry, but it's beyond me that someone actually thinks departments don't have prosecutorial discretion, despite the fact that that is well settled. Second, I've worked as a federal prosecutor, and I can promise you, for these purposes the issue is exactly the same. It is perfectly lawful for a commanding officer to decide not to prosecute a suspect. As soon as that commanding officer makes that decision, the suspect must be let go. That was true when I was a federal prosecutor, it's true now for my husband's department.
Can you point to a single case where a department was successfully sued for failing to prosecute a criminal who went on to commit crimes? If my husband's office got that complaint, he would file a FRCP 12(b)(6) motion to dismiss for failure to state a claim on which relief can be granted. You simply cannot sue for that. We have people all the time who have way more than 10 traffic violations that aren't arrested, none of them have come and killed my entire family yet. You're argument is completely specious.

Were this NOT the case then you could save your husbands department, and the rest of the agencies in the country a whole lot of budget by disbanding their traffic enforcement divisions.

Sally, firstly I am sad that your only response is to ridicule those with whom you disagree. Secondly I never suggested your whole family…I said your husband OR your children. I am quite certain that I could easily find cases where an offender who was allowed to skate on traffic charges went on to injure or kill another in an "accident". Third, you sound much more like a defense attorney than a prosecutor. Fourth, from your postings yes, I honestly believe that you think if it hasn't happened to you it must not be important or it must never happen.

Edward Loder You still haven't stated when this offender was allowed to skate on traffic charges. He was allowed to skate on an immigration violation, which technically isn't even a crime, it's a civil matter. Nothing in the article states that he got off on the "up to 10" traffic violations, you just made that up. Also, your "Fourth" response isn't a response to a question I asked, its an answer to a question you wished I had asked but hadn't, so the answer "yes" isn't really appropriate.
Sally you are being disingenuous. You know as well as I that if this person had been convicted on those ten traffic violations while not possessing a driver license he would have faced increasing penalties eventually leading to being classified as an habitual traffic offender and in some jurisdictions felony charges This would likely have led to jail time which would have flagged him on 287g and he would have already faced deportation. Unless you would like to argue that this had already happened in which case he either a)provided false information to federal agents or b) was an alien returning after deportation for a second time in which case he certainly would have met the criteria for supposed departmental priorities. You still haven't told me…and answer honestly if you can….do you really believe that if this person had NOT been an illegal alien he would have been afforded the same chances and courtesies?
Edward Loder False, that is completely false. Habitual traffic offender laws are almost always applied over a time frame, usually within three to five years. Do you have evidence that all of these offenses took place over three to five years? No. You're just making stuff up again. That's why I can't respond to most of your points, because they're based on made up facts that came from nowhere.
Edward Loder For reference, since he was found in Delaware, Delaware's law requires 10 or more moving violations within three years. If just one of his violations fell outside of the past three years, he couldn't be prosecuted under that law.
You are assuming found in Delaware means his violations occurred in Delaware. This would be something YOU are making up. Additionally since each citation would have been accompanied by a citation for driving without a license I suspect the law would differ on how often that needs to occur before one becomes habitual. If not then someone needs to take a serious look at their laws. As a former prosecutor you know as well as I that the law is NOT applied with equal weight to every individual. So I'll ask you again, do you believe the law would have been applied equally had this person NOT been an illegal? As you are a good person I suspect if the law were applied with an uneven hand in a way that was unfavorable to this defendant you would be the first to point out the injustice.
Edward Loder I didn't make it up, I never asserted that Delawares law applied, I was just using it as a reference, hence the "for reference." Quite frankly, whether the law is being applied equally is irrelevant, since ICE doesn't generally deal with legal immigrants, I'm not sure you'd have a good base sample to compare against. I don't have any support for or against ICE's policy of not deporting low-level violators. I'm only saying that ICE has the right to have this policy, and if an officer violates it, they should be punished for insubordination. That is the only assertion I have made, and you have yet to provide a viable reason why this should not be the case.
My reason remains as stated: The agent believed he was being asked to follow an unlawful order. In a country where we are innocent until proven guilty his superiors should have to prove the order was lawful before they can suspend him for insubordination. DO we really want to tell our law enforcement officers that doing their job based on their concern for public safety is likely to get them suspended? You and I have all the time in the world to arm chair quarterback and debate this in this forum, but on the street a split seconds hesitation while an officer considers what implication his actions might have on his career can get people killed. But if you haven't been there, you can't REALLY understand that down in your bones like these guys do. And nothing I say is going to change your mind. I've enjoyed our spirited debate. Edward Loder No, you've still completely missed what happened, I don't know how you do that. This wasn't about the original arrest, this was about an order later to release the suspect. It's not a split second decision in the field, it's an order later by your commanding officer to release a suspect, I cannot think of a single situation in which an order to release a low-level suspect by a superior officer would be unlawful. That order is clearly legal, there's no indication it wasn't, there's no reason to think it wasn't. None. Nada. Zip.
No I didn't miss what happened. I am not suggesting the agent's decision at the time was split second. I am telling you that when faced with a split second decision in the field we shouldn't be saddling law enforcement personnel with crap to think about such as this. Because I am here to tell you if this guy is suspended for this, the next agent will hesitate, or the one after that. You want prosecutorial discretion? Let the agent make the arrest and let the offender go through the system and have a prosecutor or a judge make that decision. Problem solved.As a former federal prosecutor I imagine there were any number of cases you declined to prosecute for any number of reasons. Those decisions were part of what you went to school for, trained for, and were paid for. Let the agent do his job, and if he wants to bitch about the prosecutor later, fine. But telling an agent not to do his job is like yelling at your dog for barking and then being angry when he doesn't warn you about the burglar in your house.
The next agent should hesitate before disobeying an order by a commanding officer. That is all that this is about.

Sally Paxton I can send you plenty more where that one came from? How about the Houston PD officer who was killed in an accident with an illegal? I can send you one of a newborn killed as well. The list goes on. You asked "when does that happen?"? It happens all the time. Maybe this is what the agent was thinking about. Maybe he didn't want someone else's blood, perhaps a brother officer, on his hands because he didn't stand up.All it takes for evil to triumph is for good men to do nothing. Seems to me, that if a US citizen would have been jailed under these same circumstances, then had the ICE agent turned the detainee over to local police rather than letting him go, perhaps this illegal alien would be in jail now, waiting to face a judge for breaking ten traffic laws.

Illegal immigration slowed down after the recession. Illegals do jobs that no one else does. This supposed ICE event was only reported on by FOX.
