School Wants to Oust Church Over Anti-Gay Sermons

The head of Miami-Dade County Public Schools wants to evict a Southern Baptist church that rents space in one of their buildings because of the congregation’s opposition to homosexuality.

Supt. Alberto Carvalho released a statement to a local television station alleging that Impact Miami’s opposition to homosexuality “appears to be contrary to school board policy as well as the basic principles of humanity.”

“I have asked for immediate legal review to seek the termination of the contract that is involved,” he told Local10.com. “I am making this decision not on the basis of policy or politics but as a rejection of prejudice and intolerance.”

The controversy surrounds Impact Miami, a new Southern Baptist church that is currently renting space inside North Miami High School for their Sunday worship services.

When President Obama announced that he had evolved on the issue of gay marriage, Pastor Jack Hakimian preached two sermons explaining the biblical position on homosexuality.

One of the sermons was titled, “Gays and Sex Addicts Can Change and Should Change.” Another was titled, “Pedophiles Use the Same Argument as Homosexuals and the Weed Smoking Community.”

“The school board chair, as well as the superintendent, have both reviewed the allegations and found this disturbing and appalling,” school spokesman John Schuster told www.Local10.com.

Pastor Hakimian said he and his congregation have been unfairly labeled as bigots. He said they are facing eviction from their space simply because he preached that homosexuality is a sin.

“It’s about a message that homosexuality is a sin that God wants to redeem as all other sins,” he told Fox News.

The church pays nearly $1,500 a month to rent the high school facility and said “as taxpayers we have the right to assemble in public spaces.”

“I never thought I would be penalized for teaching on Christian marriage and sexual ethics from the Bible – the very bible that presidents swear on,” he said.

Impact Miami is affiliated with the Southern Baptist Convention, the nation’s largest Protestant denomination. SBC President Fred Luter told Fox News that the controversy is a “sign of the times.”

“We’re living in a day and time when people are calling wrong right and they’re calling right wrong,” Luter said. “Any time a man of God stands up for the Words of God, I think we should expect opposition – simply because of the fact that God’s ways are not man’s ways.

The possible eviction has enraged religious liberty groups – several of whom have already volunteered their services to defend the pastor and the church should they be thrown out of their meeting space.

“He has the right to be able to speak on Sunday from the Scriptures and speak about his viewpoint on human sexuality,” said Mat Staver, president of the Liberty Counsel. “This is not someone who is advocating violence or some whacko that is extreme that would be a threat to society. This is a pastor who is speaking on issues from their own moral, political and biblical perspective.”

Staver told Fox News that he’s had a chance to review the pastor’s sermons and noted that the messages were in line with that millions of Americans believe.

“It is not contrary to humanity,” he said, refuting the school superintendent’s allegations. “It is absolutely outrageous that you would have a superintendent who would (think) along these lines.”

Staver called the attack on the Miami church a serious threat.

“It’s serious for all of us,” he said. “If we lose the right to free speech in this area – we lose it in every other area.”

Staver said their organization and other religious liberty groups have feared that homosexual advocates might use anti-bullying laws to go after ministers.

“This is coming right into the very pulpits of churches and pastors will ultimately have their messages censored  and they’ll be discriminated against because of the positions they take on human sexuality – and specifically homosexuality,” Staver said. “This is Exhibit A of that threat.”

Joel Oster, senior counsel with the Alliance Defending Freedom, told Fox News the U.S. Constitution is clear on matters regarding free speech.

“A school cannot be listening to sermons and then discriminate against the church based on the content of the sermons,” Oster said. “This church does have a constitutional right to use these facilities. Public schools cannot discriminate against religious use of their facilities based upon viewpoints – and that’s exactly what’s going on here.”

Andre Pierre, the mayor of North Miami, told Fox News he had concerns about the school board’s actions – and wondered what kind of an impact it might have on other religious groups renting space.

“You cannot censor his speech,” the mayor said. “The school should stay out of it. Pastor Jack is paying rent. He’s not getting the space for free.”

The mayor said he believes the school board attorney will side with the church.

“I think he’ll come down on the right side – which is – you cannot censor freedom of speech,” Pierre said. “You have to respect the American principles and you have to uphold the Constitution.”

      Nic Godfrey It's a simple matter of consent! Animals, children, and dead people are unable to give informed and mature consent as defined by the law of this country. Meanwhile two adults of the same gender are in fact more than capable of deciding for themselves if they want to partake in sexual activity with anyone, be it male or female. No evidence has yet been put forth as to why homosexuality is a perversion and furthermore, unless you "enjoy" (and I use the term loosely as enjoyment is rather forbidden) only procreational sex and have never had oral sex or masturbated or had sex for purposes other than procreation you are a hypocrite and have enjoyed plenty of perversions yourself. If you have avoided all those things then you are truly unfortunate because sex is one of the most enjoyable things two people can do and I hope you choose to experiment as you will understand where I am coming from.

Pedophilia may also be natural (while I don't know any species that do it, I wouldn't be surprised to find it) but we as a society have demonstrated that the adult brain is capable of understanding and making choices in the way that a child brain is not. Therefore most individuals (slightly more than half in this country) recognize the fact that what those two individuals do in the privacy of their bedroom in no way impedes the ability of heterosexuals to copulate. Additionally, to respond to the lunacy of Chuck up there, polygamy is also something that has lately been challenged. And why not? We see examples of threesomes all over the place in the world, and I would bet a major percenatge of the population has a threesome/multiple partner fantasy. The one argument against that I might be able to get behind is one of fiscal responsiblity: I wouldn't want people to get multiple benefits based on their married status; however, I assume that if this ever became legal they would find ways to negate this possibility.

In no way should that ever be tolerated in society. What I meant was that in nature there are clear examples of homosexual behaviour in animals other than humans. I am unaware of examples of pedophilia in animals however it would not entirely surprise me to see it. Just because we see something in nature does not make it appropriate however, the major criteria for us today is consent. Rape is atrocious, pedophilia is atrocious and necrophilia is both disgusting and atrocious. All three of these (necrophilia to a much lesser extent, this one definitely is vile for the desecration of the dead) involve a lack of capable consent and trauma for the victim (this is where the necrophila comparison falls apart) which is why society as a whole decries these acts as vile and reprehensible (and correctly so!) Homosexuality on the other hand is almost always an act between two consenting adults which in no way causes trauma to any involved in the behaviour. Why then should you be allowed to limit the rights and benefits of people for no reason other than because you don't agree with their consenting act behind closed doors.

      Andrew Nordine Yes, in the case of brother and sister we know that closely related genetic siblings reproducing together can have disasterous effects on the offspring and that this is not productive to society. Therefore there is a medical reason why incest is illegal and revilled. Homosexuality however has no such issues (I would argue that our disgust at incest has become so ingrained that in the case of homosexual incest we are still disgusted, and this will remain illegal regardless of the status of homosexual marriage in general), and therefore there is no reason why two consenting adults are unable to reproduce and eventually marry.

Companionship/love is a part of marriage, but not the whole. What you are talking about is a new definition of marriage, which means the onus remains on you to prove your redefinition, not on me to show you the negative societal effects. If you want to see the negative societal effects of a changing definition of marriage, just look around. We changed the permanence of marriage by no-fault divorce, we changed part of the purpose of marriage by birth control, and we changed the necessity for marriage by normalizing out of wedlock births and extending extra welfare benefits to single moms. Gay "marriage" is just another step in the wrong direction.

  2. Maybe it is time to evict the public schools from the American education system and replace them with an educational process whose goal would be to actually educate our children.

      Charles Capo: I think you misunderstand how genetics works. There is a rather simple thought experiment that will be quite sufficient to demonstrate how genetic information can be altered to create a gain of function and new organelles (or appendages or whatever). Lets take a simple organism with a flagellum. The DNA of this organism would encode for this flagellum and for the sake of simplicity we can say that it is an all or none code, if the code is wrong the organism doesn't have the flagellum, if the code is "correct" it will have it (this is an absolute over simplification of how genetics works, but for simplicity's sake assume it to be true). This organism already has the flagellum present as part of its genetic code. Now, assuming your deleterious mutation caused by the changing of a base pair in the DNA in such a way that a new protein is formed and the flagellum is eliminated. This would mean that all the offspring of this mutant gene would no longer have the flagellum. However, it would be quite simple for the gene to mutate back to its original base pair, which would result in a direct gain of function and an "increase of information" for the orgainsm and a new structure in its offspring. As far as increasing the actual amount of genetic code in an organism, there are many, many different processes which allow for an increase in this material; one that comes to mind is the introduction of plasmids in bactereal cultures. These plasmids are able to insert themselves into other bacteria and input their genetic code and add a new gene into this organism. This type of process is observed thousands of times a day in molecular biology laboratories across the country/world and is a perfect example of how an increase in genetic code could occur. More complex organisms have more complex ways of creating this gain of function, but nevertheless they are all incredibly observable and common features which demonstrate the incredible power of natural selection to produce evolution.

      Furthermore, argueing that simply because we don't know how something was done means that god did it is an incredibly irrational argument and has no basis in reality. Evolution at this point is as close to a fact as science allows (it is a theory in much the same way gravity, tidal force, electromagnitism, quantum mechanics, and any research article you will ever read's topic. You can never definitively prove something in science, merely support it through failing to reject the null hypothesis). As far as the big bang theory, we are in fact able to demonstrate how the universe can come from nothing as evidenced in Lawrence Krauss's new book entitled A Universe from Nothing. Furthermore, scientists in particle accelerators across the world are creating conditions similar to the start of the universe and are better able to understand how these things are in fact possible. Learn something about science and the topic you are criticizing before you spout your ignorance.

      As a matter of fact, a mutation is more than capapble of simply duplicating a particular genomic sequence, which would then simply create more of a protein. THis then can be mutated in a DNA base pair swap which would change the protein and then create new functions. Also, your bullshite line about no observable process for increasing genetic information clearly just shows that you are illiterate. Because I explicitly demonstrated the fact that Plasmids in bacteria are observed thousands of times a day to increase the genetic code of a bacteria. That is merely the SIMPLEST example. Read a book

As far as the gay gene is concerned, there is evidence of a genetic predisposition towards homosexuality which, similar to schizophrenia, is then expressed based on environmental influences (in this case the hormone levels in the womb). I am willing to admit that all the factors and EXACT method of predisposition is not yet fully 100% realized and charted, but that's what Science and scientific theory is all about now, isn't it? My focus has been on the hormonal factors, and since that book had been so widely panned and discredited, it has been my experience in arguing this position that any mention of a "genetic" cause is usually quickly sneered at from the opposite camp, with an immediate reference to the aforementioned book.

      Comparing homosexuality to schizophrenia doesn't mean that homosexuality is a disease, it merely means that both have been linked to genetic causes, however genetics is not the ENTIRE cause. The gene for schizophrenia does not necessarily cause schizophrenia, as evidenced by only a 50% concordance rate among identical twins with schizophrenia. The numbers are actually somewhat similar to homosexuality which indicates that there are other factors involved in both, but that there is still a definitive genetic link. Sin also doesn't exist. Schizophrenia was merely the first that came to mind for me because I happen to be a neuroscientist who in fact studies schizophrenia as my area of interest. The fact is that all I claimed was that genetically, there is approximately a 50% concordance rate for homosexuality between monozygotic twins (identical) which indicates a clear genetic link, but there are many environmental factors that then are required to activate the genes in a process known as epigenetics. It is a fascinating field, but judging by the quality of conversation we've had on this page so far, it is far beyond your mental capacity to understand so I won't try to explain it here. But if you're interested I suggest you look it up. Nevertheless schizophrenia was merely an example I used for the mechanism of the genetic causes, not evidence that homosexuality is a "disease" that can be cured. It was in hindsight a poor choice because I should have known that closed minded bigots like you would take it out of context and misuse my argument so I apologize for giving you that opportunity.

The idea finds its origin in a speech by Thomas Jefferson not in law. Admittedly the framers did NOT want the Church to have power over the States and vise-versa but no law prohibits the exercise of both in the same place at the same time.

      The 1st Amendment prohibits the federal government from passing law supporting or denying any particular religion or the free exercise of religion. The 14th Amendment holds the states to the same prohibition of authority.

      I considered bringing that up, but a treaty cannot bypass rights guaranteed by the Constitution. It is not possible to make an end run around the 2nd amendment and take our guns. They might try strictly limiting manufacture and sales though. Leaving you with the same right to own a gun and no place to buy one. Also it takes a 2/3 majority of the Senate to ratify any treaty we enter into and with the Senate being close to 50/50 nothing that affected 2nd amendment rights would come close to passing. Now Obama can make Executive Agreements without the Senate's approval but that wouldn't happen in this case. I am far more concerned with what is going on in Nanny states like New York and their gun laws. And their record crime rates. People like Bloomberg want to apply New York laws to the entire US. And it's interesting I got accused to looking to Fox News for "what to think." Rupert Murdoch came out in support of strict gun control himself. Times are getting interesting.

    OK, so the school should continue to rent to the church group, because if it doesn't it needs to kick all religious groups out. But I must say I do enjoy reading how pissed off everyone is. Ever since fox turned off the comment section on most of its articles, it has been a little harder to get my fix of angry conservatives who are convinced the country is going down the tubes.

    Unbelievable. Everyone pays taxes to support the educational system, even those who think, for example, that (insert your favorite gripe) is a mis-use of taxpayer funds. The school can legitimately rent out the facilities for such things as a meeting for county farmers, wedding receptions, concerts for which admission will be charged, etc., as my own school did, and even DUH! a church service. Never mind that the groom at the wedding is a womanizer and thus has a 'shady reputation', or the concert features all the music you can't stand, or the farmers come with you-know-what on their boots and need to wipe their feet before entering. So you pay your money, you rent your space. The School Board/Administration is being way too arrogant and haughty and should remember who it is that makes it possible for them to get a paycheck. All taxpayers should have equal access to such facilities and should only need to comply with normal and reasonable rental requirements.

  42. I'm in full suport of the Baptist preacher. I'm a Christian and I know what the Bible says about homosexuality. God destroyed Sodom and Gomorrah for its sin (Gensis chapters 14, 18 and 19). Paul in his letter to the Romans was quite clear and precise about God's judgment concerning sin (Romans chapters 1-3). Now Christians are told by Christ and the Apostle Paul that they will be presecuted, and hated for being followers of Christ this is nothing new. Christians are commanded to contend to the faith (Jude 3) and Peter said to speak the word of God (1Pet 4:11).

I also appreciate that a taxpaying public should not have to provide a space for people to propagate bigotry and discrimination toward a noncriminal portion of the population.     Also, I certainly have compassion on and have personally encouraged and prayed with homosexuals who knew that their sin was wrong (just as heterosexual sexual sin is wrong). It truly breaks my heart to see someone in unwilling bondage to any sin.
    What I do have a problem with is when any group tries to change society to not only accept their sin as normal, but to encourage and applaud those (including children) who proclaim that they are proud to be involved in this nightmare that is so-incorrectly-labeled Gay. They are greatly more likely to suffer depression, alcoholism, drug abuse, STD's, suicide, etc. I believe if truth-in-labeling laws applied, it would be renamed Horrific instead of Gay.
