School District Bans PTA Ice Cream Sales

A New Jersey school district has ordered the PTA to stop selling ice cream to students on campus because the longtime fundraising violates state and federal law.

For years the PTA in Parsippany, New Jersey sold ice cream once a week on campuses across the district. The money was used to fund cultural arts programs and field trips for the students.

But earlier this week, the district superintendent sent a letter to the group informing the parents that those tiny cups of ice cream could no longer be sold on campus.

“We don’t know the full extent of the issue, but the PTA cannot sell ice cream during our lunch time hour,” PTA president Liz Kadian told Fox News. “It’s disturbing to many parents.”

Supt. LeRoy Seitz told Fox News that the district has no choice in the matter.

“While we fully understand that our students enjoyed the PTA ice cream fundraisers in the past and that the ice cream sale fundraiser was very successful for our PTAs, we cannot approve activities, including PTA ice cream sales that are in violation of state regulations,” he said in a statement.

The law forbids any food sale fundraising efforts during the “hours when our school nutritional program is in operation.”

“It is unfortunate that we cannot permit the PTA ice cream sales during the hours that lunch is being served and again, we have asked our principales to work with his or her PTA to find other opportunities to fundraise that are in compliance with state regulations,” he said.

“I think it’s ridiculous and a majority of the parents feel the same way,” Kadian told Fox News. “It’s a once-a-week treat.”

Dozens of parents are voicing their extreme displeasure about the new ice cream ban on the Parsippany Patch website.

“I can only imagine what will be next,” one parent wrote. “Will the school board start checking lunch boxes making sure that parents did not pack too many Twinkies or yodels?”

“Whether it is federal, state or local government-mandated, another piece of childhood innocence is being taken away,” another parent wrote. “How sad that an elementary school child can’t look forward to buying something as simple as an ice cream bar once a week.”

Last week more than 1,000 students at Parsippany Hills High School staged a strike against the cafeteria to protest federal guidelines governing portion size. As a result, a number of parents are now packing lunches for their children.

Kadian said she understands the USDA’s concerns over healthy lunches – but she noted that the ice cream they sold met state guidelines. The ice cream cups contained about four bites of – and the ice pops were sugar-free.

Teachers also used the weekly ice cream sale as an incentive – offering students the chance to earn certificates for a free treat.

But Kadian said the bigger issue is fundraising. Without the ice cream sales, many student activities could be jeopardized.

She said the PTA will be meeting soon to discuss their options.

    I went all the way through high school eating one nutty buddy every day for my entire lunch. My more nourishing meal was dinner. These food dictators ought to get a life. Do we need to add a constitutional amendment for freedom of food choices?

    • You do not have the freedom to sell whatever you want on public school grounds. With that said this is ridiculous and I will personally be contacting my representatives and making them aware of my ridicule for this portion of the nutritional mandate.

    • You think groups have the right to trespass and sale food products on public school property? I do not agree with this mandate, but breaking the law does nothing to effect change. Contact your representatives and vote for people who will effect change.

    • Who's going to enforce the law? I'd love to see cops go to the school to arrest taxpaying parents for selling ice cream to raise money for their children. Yeah. That will go over well.

    • Trespassing is a crime and being a taxpayer does not grant you any special access to public school grounds. Would there be outcry? Sure I expect there would be, but the cops would not care they would enforce the law.

    • Well maybe that's what it takes to get things changed. We need to stand up to these dictators who want to control our lives. Push the issue. Say enough is enough and stop following their rules. Force them to waste money to jail us. Force the issue and make everybody wake up and realize how much of our freedoms we are losing in the name of public health, or security or safety or whatever asinine excuse they use.

    • The only thing that's going to start bringing the necessary attention to these issues is protesting and challenging these foolish regulations/laws. Too many people have no idea what's going on, how the government is getting far too involved where their noses don't belong. The more press coverage, the more people will start raising eyebrows and pushing back. The time for change is now and I have little faith in our politicians at this point.

    • Nobody will get arrested. What will happen is the school district will lose federal funding for not complying with the nutritional mandate. This is what happens when we depend on federal money. When the government is able to give you everything you need they will have the power to take away everything you have.

    • I don't think Patrick Mares is advocating people being arrested. I think he's simply ensuring that folks are "forewarned" about what could happen to them should they engage in "civil disobedience" and sell the ice cream to the kids. Nothing in his comments indicate that he's an avid supporter of Mrs. Obama's "starve the kids" program. In fact, I'd take an educated guess that he's probably in support of this sort of action.

      As a teacher, I see the frustration daily. The kids miss the "favorites" that they've had on the menu throughout their time in high school. They aren't angry with the folks working in the cafeteria, as they know that ultimately they aren't the ones responsible for making the decisions on what can and cannot be served. They are saving their wrath and disdain for the person that we've "elected" to be the first lady.

      I've seen more and more kids packing their lunches in recent weeks, and I suspect that the trend will continue. I did stop by our Food Service Director's office yesterday, and told her that Michelle Obama said "howdy." She threw me out of her office.

      With regards to trespassing on school property, schools have really cracked down on "strangers" in the building. I know that they are public schools, but they generally have the authority regulate who gets access to the building when students are present. Again, I don't think Patrick Mares was intending to be part of the "evil empire" that is the Obama administration.

      What will it take for people to wake up? I think we are past that point. People will leave their kids in these institutions and continue to complain about them.   7. I have an idea. Set it up across the street. Or just say screw it and do it anyway. Force the bureaucrats in charge to call the police if they care so much. The only way that these rules and regulations matter is if we follow them. Call their bluff. Force them to make a scene. If these people care about students they will ignore the unjust rules and continue to raise money for their students.

      Just have the sale at another time…we have the same law in Rhode Island and our PTA's adjusted to it by holding the sales of ice cream, baked goods etc. at other times and on school property. Some of the PTA's (with permission of the Principal) sell popcorn, ice cream at the close of the school day when parents are on sight for pick up. It accomplishes the goal of raising funds and it gives the kids a treat. I do agree the law is silly, since the food the kids are offered as "healthy" meals is nothing but junk!

    • Patrick Mares When I was in school ice cream was available every day at lunch for 10 cents. I'd get an ice cream 2-3 days a week. Some kids ate them everyday, and you know what, there were only a handful of chunky kids that I remember all through grammar school, and actually less in high school.     My friend and I run our local Elementary Schools Bake Sale. Last week the Regional Manager for food services showed up personally to shut us down. Meanwhile, my son was given dry cereal without milk for lunch because "food services" ran out of food. With this money the PTA pays for our librarian, PE Teacher, and our music teacher. These regulations aren't about keeping our kids healthy. Food services looses money if kids don't buy their lunches. This was all started by the Michelle Obama healthy food act. Thanks a million!

    My kids' school stopped doing this last year for the same reason. My daughter was devastated! If I want to send money for them to have ice cream, then obviously I am ok with them having ice cream! That was when my then 7 year old knew that Obama was a bad president! Haahahaha!

    • I've been saying that we are "Frogs in a pot" for years. Stand up for your rights as parents, I did. Here is just one of the many examples…..The school nurse told my daughter that it was her decision as a "licensed professional" to determine wether or not my daughter was sick and refused to call me. Well……we took the decision out of their hands. The next time my daughter fell ill at school, she called me, I picked her up and then called the school and said she wouldn't be back for the day. Haha, they flipped out!

      When my father died, they refused to call her out of class, I flipped out!! I barged into the principals office (while he was in a meeting) and guess what….they called her out of class! After dealing with the "professionals" in our schools for 16 years, they were glad to see my children graduate and Go!!
      P.S. I packed them a sack lunch! P.S.S. Remember… You are in charge of your children, not them! Get involved, make your voice known and VOTE!

And as far as the change to the school lunch program, can you imagine what the outcry would be if a Republican president and Agriculture Secretary advocated a change to the school lunch program which reduced portion sizes AND raised the price AND said it was in the name of reducing obesity?       While a ban on ice cream certainly is ridiculous, school lunch prices are largely dictated by state law in Pennsylvania and have nothing to do with liberalism.

      Randy, this is no longer true (not sure if it ever was), but due to the new regulations, lunch prices will have to go up. There was an article about it in our paper in PA. The Feds only reimburse so much, but the states still have to adhere to the guidelines. The new guidelines call for more fresh fruit/veggies, which is more expensive. The district I live in was on the record in our local paper saying that prices are status quo right now due to deals they cut with local farmers (getting some of their excess), but once the season is over they are anticipating an increase directly related to the new guidelines. The Feds often enact things and then force the states to pay for them. I also regularly volunteer in our lunch room and the amount of food being wasted is incredible.

  24. Our kids have access to junk food 24 hrs a day in our home, we eat it sometimes we also eat healthy. We don't make a big deal of it. My wife and I are reasonably active and our kids are skinny as rails. I think it is the active example you set not the food.

    Those state laws are based on a federal mandate. They are breaking a law from the Fed, however ridiculous. This is DC's answer to every problem: legislate. If most people realized how controlling the fed is over every public school in the nation, there would be a national outcry. We need to end the DOE and all of this nonsense as well.

      This law was most likely lobbied by ARAMARK who operates a very profitable snack bar during lunchtime hours. School lunches contracted out to large corporate entities are atrocious.       True story, I don't know why, but I cannot eat most of the food they prepare. It causes my acid reflux to go full bore. Something they add, simply doesnt digest for me. I love our cafeteria people, but there is def something to your point about addititves.

      Ann Miller you are so right! In Rhode Island Sodexho has the food contract for all of the public schools and they have within the contract a "no competition" clause which does not allow the school to offer anything but their products while the "nutritional program" is in operation. The state doubled down on the law by prohibiting any parties in the classroom that includes "unhealthy" snacks. But…the kids can bring whatever they choose in their own lunch boxes to have during lunchtime! Annnnnnnd…the "healthy" snack initiative is subjective because our teachers have been very creative with these "healthy" snacks while having a special party in the classroom..:)

  29. Our school district inspects lunch bags and takes items away that have been banned. Next the "Gubermint" will determine which kids need meds and parents won't have a choice… Whoops already done!

    • Morons! Even apart from the nanny state thing, ice cream may have sugar but it also has milk. One of the more nutritious snack foods really. And fewer Weight Watchers points than something like cake (which I'm sure the school aslo bans.) Not that the nutrition matters since the MAIN thing is the nanny state business.

    This idea about selling products off school ground don't make any sense, the kids can't leave school property during school hours unless they are with their parents.

    They only thing that will help this situation and every other idiotic situation that keeps coming up concerning these schools is to pull your kids out of them in mass exodus. That is not breaking the law and that is the only thing that makes sense.

    When you pull your kids out of those schools, these indoctrination centers lose money. If everyone that is tired of this garbage that is going on in their communities pulled their kids out, they would be able to afford a private education. Tuition is dependent upon a student body. If there were an influx of kids in a private school near you, tuition goes down.

    If you say that you still can't afford a private school, then home school them. There are plenty of home school curriculum's out there that offer sound, educational principles that are DVD driven. Many churches offer home school co-ops where parents that know different subjects, such as math and science and home-EC teach as well. There are other venues available, but you need to decide what is best.

    Only you can affect change. If you want what is best for your kids and for your nation, pull your kids out and sacrifice for them, and get them educated not indoctrinate.

    Quit complaining and start acting. Take charge of your kids' and your nation's future and save them from this garbage.

  37. I have long said that the schools only pay lip service to caring about the family unit. They truly want a breakdown of the family and maintain more control over the children. I would also bet that soon the Food Service Personnel will be selling Ice Cream as a treat. They just saw an opportunity to make some money. Parents need to start standing up to these ridiculous school boards and completely over the top state laws. How do these things even get passed? Boycott school lunches and hit them where it hurts, it doesn't take that much effort to pack a cold lunch. At some point, in many areas, parents are going to have to boycott schools themselves. Have the students "go on strike" until things are brought to a less ridiculous level. Teachers need to focus more on education the children and less on influencing(bullying) them with their own political ideals and personal values. We as parents didn't have children to provide them with a job, they were given a job to educate our children.

  41. I've seen those school lunches, they look custom made for the little people from Oliver Twist. If you'd have tried to serve that to me when I was 15 I would have laughed in your face. My suggestion is to make a little more at dinner and pack your kids sustaining lunches from the leftovers – it seems to really school systems and the gov when you don't participate.

    This is the problem when government runs anything. They lack common sense. Each school has to make some decisions on what works best for them. But instead they have to follow every government program to the t. And it seems to do abosolutely no good in the end. Eating healthy is great. But someone doesn't change all their bad habits overnight. The schools should have been allowed to ease into changes and make some of the choices for themselves. A little bit of icecream every once in awhile isn't going to hurt these kids.

    Attention Disgruntled Parents: Having heard the complaints about the state law not allowing the PTA to sell ice cream to raise money for cultural arts programs and field trips, we, the State, would like to take this opportunity to explain why this is in your best interest. As you know, the children's obesity rate is skyrocketing and something needs to be done. Hence, the state regulations dictating what you shall eat and when you shall eat it. This state law has been implemented because evidently you can't control your child's caloric intake so we, the state, must do it for you. In case you are worried about who wrote these laws and what their qualifications are you need not worry. If you were qualified to do what we do, you would be writing the laws( makes sense, right?). We have also noticed contraband coming into the school during the morning hours ( Twinkies, cup cakes and the occasional snickers bar). Please be advised that on November 1st, 2012 school administrators designated by the state (these administrators have passed a rigorous background check and are fully loyal to the state) will be making random lunchbox checks to intercept said contraband. We appreciate your cooperation in this matter.

  45. What about giraffes? I want to give away all my rights too! I want to be banned from eating the foods that the government deems unacceptable too. Why haven't they taken my rights away yet? Doesn't the government like giraffes? Why can't I give up my common liberties like so many people have? Why won't the government manage my life and make choices for me like they do for so many people? I feel so left out.
