Man Facing Jail For Hosting Home Bible Study

A Phoenix man has been sentenced to 60 days in jail after he refused to stop hosting Bible studies in the privacy of his home – in violation of the city’s building code laws.

However, the Phoenix city prosecutor’s office said the violations have nothing to do with religious freedom — and everything to do with public safety.

“It came down to zoning and proper permitting,” said Vicki Hill, the chief assistant city prosecutor. “Any time you are holding a gathering of people continuously as he does — we have concerns about people being able to exit the facility properly in case there is a fire — and that’s really all this comes down to.”

According to court documents provided to Fox News Radio, Michael Salman was found guilty in the City of Phoenix Court of 67 code violations. He was sentenced to 60 days in jail along with three years probation and a $12,180 fine. He could be jailed as early as next week unless the U.S. Ninth Circuit Court of Appeals grants an emergency injunction.

“They’re cracking down on religious activities and religious use,” Salman told Fox News Radio. “They’re attacking what I as a Christian do in the privacy of my home.”

“If I had people coming to my home on a regular basis for poker night or Monday Night Football, it would be permitted,” he said. “But when someone says to us we are not allowed to gather because of religious purposes – that is when you have discrimination.”

However, the Arizona courts consistently ruled against Salman – ultimately declaring that he was engaged in church activities and that the city did not violate his constitutional rights to religious freedom.

The long-running feud between Salman and the City of Phoenix culminated in the summer of 2009 when nearly a dozen police along with city inspectors raided their home. Armed with a search warrant, police confined the Salman family to the living room as they combed the property looking for violations.

Salman is the owner of Mighty Mike’s Burgers — and he is also an ordained pastor. He and his wife have been hosting Bible studies on their 4.6 acre property since 2005. The gatherings were originally attended by as many as 15 people.

Hill said the city became aware of the meetings after neighbors apparently complained about traffic congestion.

In 2007 they received a letter from the city informing them that the Bible studies were not permitted in their living room because it was in violation of the construction code.

A few months later, members of the Phoenix Fire Dept. broke up the family’s Good Friday fellowship. As many as 20 people were in their backyard eating a meal when firefighters threatened to call the police – unless their guests left the premises.

“Immediately after that, we decided to contact an attorney,” Salman told Fox News Radio. “The city emphasized that bible studies or church-related activities are not permitted on residences because you have non-family members coming to the home and such use is considered church use.”

In the summer of 2008 firefighters once again broke up a gathering – and Salman finally reached his breaking point. He ordered the firefighters to leave his property.

“We told them they had no right,” he said. “They had been harassing us since February. This is our home. We are a private gathering. This is Christians gathering on my private property.”

The city ignored the Salmans until 2009 – when they built a 2,000 square foot building in their backyard. Salman said he applied for and was granted the proper building permits. He also said the building has passed a city inspection.

“At that point we took our Bible study from our living room – and we moved it into that building,” he said. “We started worshipping in that building every weekend.”

However, Hill said Salman has “mischaracterized the facts” of the permit. She said he was given a permit to convert a garage into a game room.

“Any other occupancy or use – business, commercial, assembly, church, etc, is expressly prohibited pursuant to the city of Phoenix building code and ordinances,” she told Fox News Radio.

On June 11, 2009, the Phoenix Police Dept. showed up with a search warrant. When they had completed the search, Salman was charged with 67 code violations.

He was charged with not having emergency exit signs over the doors. He was charged with not having handicap parking spaces and not having handicap ramps.

“Imagine everything that a public building would have or a commercial building would have,” he said. “Anything we didn’t have was a violation.”

The largest source of contention has been whether or not Salman is running a church. He insists it is not.

But his building certainly resembles a church. It has chairs for as many as 40 people. There is a pulpit. There’s a sign out front – along with a cross.

“Just because visitors come to my home three times a week and we discuss the Bible – if that’s their definition of a church then so be it,” he said.

“At what point does the government have the right to state that you cannot have family and friends over at your home three times a week?” he asked. “People have a right to gather on their property as long as parking is available, as long as they aren’t parking in the street, as long as they aren’t violating noise ordinances.”

Hill said the facts are clear.

“He built a structure that he said wasn’t a church — that is in fact — a church,” she said. “It’s a church.”

And the courts agreed — noting in a Jan. 4, 2010 ruling: “The state is not saying the Salmans can’t run a church or have worship services at the location. But the state is saying that if they do so, they must do it properly and in accord with fire and zoning codes.”

Salman’s attorney has filed an appeal with the federal court – and unless they intervene – Salman will start serving his sentence on July 9.

A church is not a public place it was meant for believers and has the right to say who can and cannot be there. Unlike a business which cannot discriminate si easily. That is not meant to be rude but read Matthew 18 Jesus meant the church to be those coming together who agreed on beliefs. Ps the flip side to this story if people got hurt due to code violations how many would be griping

  5. I love how the Salman Cult is just so harping on all these religious things. The city/state really is not in some giant stupid conspiracy to prosecute the poor misunderstood christians. It's about permits and zoning codes.

    I would like you to notice the statement of the Assistant Chief Prosecutor for the City. As long as we were using the building as a Gameroom we are O.K. It is when we start using it to host worship with our friends it is wrong. And that is how it should be. You have a permit to have a Gameroom, so if you want to use the building as a gameroom, that is your right. You do NOT have a permit to build a church, so using that building a church IS NOT YOUR RIGHT.

    Stop trying to cry about how you are being victimized for your religion. Get the stupid permits already, like you should have done in the first place, like EVERYONE ELSE is required to do and I doubt you'll have any more problems.

    Contrary to what you zealots think, the entire world does not sit in awe and wonder of you and your religious beliefs.

    • For him to have a commercial (and that includes churches) on his property, he would have to provide off-street parking for them PLUS he would have to get permission from each neighbor, which he clearly has not done.

      After reading the entire article I must saddly say that both sides are right and both sides are wrong. However, I find the Pheonix authorities actions excessive and (though they seem to deny it) motivated by seeking to keep Christians from practicing their religious beliefs. I grew up attending home Bible study groups and never had a problem with it. Many of today's churches have grown out of home bible study groups. Sad to think what God must think of this nation and how He will punish us for the turn from Him that we have allowed our local, county, state, and national government officials to take daily.

    • Lisa, how is the city wrong? Can you explain your logic in this? Michael did not do his due diligence with the city. They took action after neighbors' complaints. It is NOT ABOUT a home Bible study. It is about a registered church meeting without permission in a residential zone. Plus Michael was deceptive with the city as to the use of the building. This is NOT about the Christians vs the lions. It is about one deceptive person hollering "victim" and stirring up trouble. Last time I heard "bearing false witness" (a.k.a. lying) is one of the basic "shall nots" in the 10 commandments. Uh, yup, ::checking:: it's still right there in black and white.

      I think it was not the legalities involved it was the government taking the stand against an organized meeting where christians were worshippping God- there are lots of loopholes in today's legal system but I for one would not want to meet Jesus at the Pearly Gates knowing I had disbanned one of his- just because it was not what the neighbors agreed with. Apparently the authoriities decided to take agressive action instead of a sit down, talk it out, compromise and even assist in the corrections of the issues. Enough said………

His plan was to have an entire church complex. He has changed his story to get sympathy, and obviously it has worked by the comments on this article. None of the truth is coming out in these articles or the stuff he posts. Luckily the city has seen through his games.

    • If you go to his YouTube videos and look at the comments, you see defenses from this congregation which liken this church to the Branch Davidians and compare code enforcement to the FBI/ATF. That's from the people who GO TO the church. That's pretty scary, too. I don't see what's so charming about him, but apparently he's a very convincing con man. He was trying to build a "Branch Davidian like" compound. Scary!

  9. What really bothers me about all of this is not the fact he was found guilty. It is the sentence and fines. How many Movie stars get arrested for DUI and other such crimes and spend only a few hours in jail. We also never hear how much fines they may pay but I bet its no where near what Salman may have to. Brace yourself Christians the persecutions are just starting.

    • You're right about movie stars, but this guy fought the law for 8 years, all the while having a registered non-profit at his house, making money off the operation. He's been repeatedly arrested for cons like this, including churches whose coffers he has robbed. This man is not a victim or a Christian. He also went to prison for a drive-by shooting. Do a little research and you'll see what I mean.

    • I am not one of the council persons. This case was brought to my attention because of supposed 'discrimination' by a Christian friend of mine. He asked me to look into it to see about helping this guy. When I looked into it, I found out he has a registered church at his home, he just spent six years in prison for a drive-by shooting, he had these same problems in California, he intended to start a full Koresh-style compound, he's a convicted con-artist who lives in a half million dollar house (that's a lot in AZ) on church money and stolen credit card technology. Nevermind the runon sentence; just scroll down and read. Most of the links are posted already (many times now), so I don't want to keep posting them. I'm an atheist and often at odds with Christians, but this makes me angry that he's lessening the attention of actual persecuted Christians, Jews, Muslims, atheists, and others with his con-game.       My apologies if I sounded gruff. I can't say I'm an active religious person, but I do believe in a higher power, just not as portrayed in any organized religion. As you said, there has been a great deal of govt interference in the practice of religious freedom. The article depicting his trying to do nothing more than bible study is as skewed as much of today's media. We should be hammering on them as much as on Michael. I very much appreciate your civil response and thank you for your comments.

    • No problem. I try to keep my cool, no matter how frustrating it gets. It's an emotional topic, for sure, so I can see where people get pretty worked up. I"m just trying to get the truth to people. Some people don't want it, and that's fine, but for those who do, I want to make sure they get it.

This guy set up a church to get money, lied on his paperwork, built a branch-Davidian style compound, put up a building with two little doors on the front for up to 60 people to occupy, etc, etc. He's a convicted conman, not a "poor Christian being discriminated against". Nobody's taking his freedom of religion. They're taking his freedom of being a conman with no regard to the safety of parishioners in his registered church facility.

      I can certainly understand the frustration. I do have a philosophy of not making a judgement about an issue until I have researched the facts about that issue or situation. Unfortunately, I let my emotions get in the way on this one. I'm still researching this situation and don't know the facts, so I will refrain from comment until I know what is really going on. There is likely others that haven't looked into what is truly going on with Michael Salmon. If he is as the media is representing, then he has a problem. On the other hand, if he is merely holding bible study, for a few friends and family, then the city has a problem!

First of all, Why are so many people hating, It is clear from the testimony of the prosecutor that the CHURCH or GATHERING was the Target, If the enemy was a Christian then I would say okay lets listen, But she is clearly not a Christian and they were only concerned with the 12 thousand dollars, If the federal government didn't label him a REBEL or a TERRORIST then she would not have suceeded, Christians are a dying race and every real christian knows it, Many people come to god and very few stay, Its written clearly in the bible. All the haters on here want to discuss blah blah blah, Truth be told City Codes are not their for any other reason than CONTROL, Its so simple, They don't care about safety, they follow the Agenda 21 to the T in Arizona. As do most states, But I say get the money together make it a church officially, Its no good to let them win, when you can just play the game and win yourself, The reality of it is that the people they are attacking are a small group with less power, Look at what they did, And then look at the building code violations they ignored, JUST LOOK AT THE CITIES GOVERNMENT BUILDINGS, Many are exempt from many codes? Why is that? The rules are not for the rulers!

    • Nicholas Allen If it were bible study, I'd agree with you. However, he has had a non-profit organization (church) registered at his 'house' since 2001. That's not just bible study. That's a church. Or you could check out his CHURCH website or CHURCH YouTube channel. Or you could check out his criminal record, including CHURCH scams. Or you could see that he lives in a 500,000 house off of money he gets from this church. Or you could just spout nonsense without actually knowing what's going on, because Fox news won't give you the real story, because they want to cause division and strife for profit. Google "Mike Salman" and get the 'rest of the story'. I feel like I should post a blog up about this guy as much as I find myself repeating this information. By the way, did you just say the Christian Bible doesn't tell us to obey the laws of man? The Bible I read teaches us that Jesus said to obey the laws of man. I guess only you get to cherry-pick, right?

  14. Am I reading the same article as you guys? I'm an active Christian but totally disagree with this guy. He had no jail time until he built a building by lying about it's use to the codes dept (it's not a game room) and than over reaching the occupancy allowed at a residence. I have a friend who has huge parties at his house every weekend (50+) the city approached him after receiving neighbor complaints and he got his great room rezoned as a "dance hall" and added exits with signs, parking, noise control devices and the whole bit. He didn't claim harassment he just acknowledged the laws and followed them. Shame on this guy for dragging Christs name into his bull headed fight against the laws of the country he chooses to live in.

  15. My only observation is that they were fine with the garage being a game room.
    If the same amount of people used that game room as a game room, would it then need to be zoned as an arcade? If he tossed a poker table in there and the same amount of people played poker there, would it need to be zoned as a casino? If he had a TV in there, and the same amount of people watched movies in it, would it need to be zoned as a theater? If the same amount of people had nachos in that room, would it need to be zoned as a resturant? If the same amount of people went and got a beer out of the fridge that may or may not be in said room, would it need to be zoned as a bar? If the same amount of children had a sleepover in that room, would it need to be zoned as a motel?

    The Editor of Foster newspaper I heard from a very well respected person is telling that my wife and I did not buy land on Wheel Wright Pond in Lee NH. I herd that he told County Commissioner George Marglaris that my scheme is an election year ploy to get votes. The ethical and moral ramifications from the editor of a newspaper so harming US Military Veterans with lies is wrong and the Fosters newspaper is just a rag as this shows. I was so stunned when the first person told me this that I started asking well to do citizens Rod and I had in common and they confirmed the facts of what roomers of Rod’s lies. During the confirmation of the facts is where I was told of George Marglaris was one of the people Rod talked too. The question is does Rod have the moral and ethical Wismar to stand behind what he is saying about others. The more important question is will the Foster’s print the truth of what is going on. It is not just Rod I also herd that editors of other newspapers warns the reporters doing news on the election to avoid me or interview me by telephone for fear of the danger that this candidate is running for NH State Senate. The Portsmouth Herald is doing a story on me this Sunday. I do not know what it will say well or bad. I hope the one point that I got through to the reporter is that my letters come from disabilities that I received defending and protecting this great nation.
    My wife and I put our life savings on the line to purchase the property on Wheel Wright Pond at 101 Stepping Stone Rd Lee NH for the express purpose of building 12’x24’ cabins in the woods for homeless and/or physically-mentally disabled US Military Veterans to live free of charge to try to come back. We want to build a handicapped access down to the water edge and paths around the eleven-acres for the veteran to find God and themselves as the speed and rate of their own will. The harmful effects of Rod or any editor’s words expressly a character assignation becomes so harmful it is beyond reproach. The Veteran Resort-Chapel was approved by the State of NH on 9/19/12. The book 4041 and page 0141 of the Strafford County deed of records is public knowledge where Rod if he had wanted to tell the truth could confirm the facts. My wife and I also mortgaged our home to the hilt to continue this venture. What right does any editor have to question the sheer fact that my dream to help other disabled Veterans have a chance back here could be so selfish as to use it to get elected. To me the election is my way of volunteering to help as a volunteer the State of NH. If I did get elected my using this elected position to help other veterans while filling my job as an elected official is what I would do. I believe that even though only eleven percent of the US population every joins our Armed Forces they deserve more than homelessness. I believe Rod is a Veteran but his actions are deplorable. The Fosters and any newspaper not printing this opinion letter of a US Military Veteran being wronged by the news media is an example of the toilet that freedom of the press has become.
